Is Your Property Maintained?

As a landlord, it is your duty to maintain the property in a manner that will keep your tenants happy. What kind of landlord are you when it comes to making repairs? What are your policies on making building and tenant repairs? Your attitude toward repairs and maintenance of your property might be an issue in your eviction case.

• Did you fix up and paint the apartment before the tenant first moved in?

• Does it take weeks before you get around to fixing something in your tenant’s apartment?

• Does your tenant call the housing inspector about needed repairs before calling you? Is the tenant doing it because you have a history of not responding to repair requests?

• Do you have a policy of not making repairs until the item needs to be replaced?

• Do you constantly say you do not have the money to make repairs but come up with it after the housing inspector calls?

• Have you tried to fix housing or building code violations before taking the tenant to court? Did the tenant cooperate by allowing you in the apartment to make the repairs? Can you prove noncompliance by the tenant?

• When was the last time you saw the inside of your tenant’s apartment?

Before you start eviction action, know that some of the habits exhibited above could go against you in court. It could show a history of not maintaining the property or keeping it up to the state building or sanitary codes. If you do not have a properly maintained building or apartment, expect the tenant to go to court with pictures of your property as a defense for not paying the rent.

A poorly maintained property or apartment could have a serious impact on your eviction case. Some judges will not continue your case until a city housing inspector surveys the tenant’s apartment and the building. Any repair or other issues, such as a need for pest control, will stop your eviction. Until the city and state building code violations are corrected, your eviction case is held for further consideration.

After you make the repairs, you are responsible for calling the housing inspector for another inspection of the property. If all is well, then ask for a new court date.
